Mediation: Where there’s a will, there’s a way…

Broadhurst LLC is excited to be the Cayman Islands’ liaison for the upcoming London School of Mediation training conference taking place in Grand Cayman.  The conference takes place from Monday 6th May to Friday 10th May 2019, from 8 a.m. to 1:30 p.m. daily and those attending gain certification as a Mediator.

What is Mediation?

Mediation is a dispute resolution option, which is alternative to a court hearing or trial. A neutral facilitator, the mediator, assists the parties in crafting a resolution of the issues between them.  A skilled mediator is adept at exploring the options which the parties themselves generate and making their own suggestions when there is a threat of deadlock. 

The mediator will help to bring the dispute to a conclusion with a solution which is a product of the input of the parties themselves.  Rather than have a court make decisions, the parties retain control of their own destinies. For that reason, mediation has also been shown to be a much more satisfying manner by which to resolve disputes. Rather than having a judge, magistrate or arbitrator dictate a resolution which may not make either party happy, mediation allows for the parties to retain control over what best meets their needs. 

It is also the parties’ choice whether to attend and resolve a dispute at mediation. Whilst mediation is encouraged as a means of resolving disputes by the courts in England and Wales, and across Europe, it is not an obligation and the parties can decide whether to attend mediation or not, and if they do choose to attend, whether or not to settle their dispute.
